HOW TO CHOOSE A PATENT AGENT IN VIETNAM

To file a patent application in Vietnam, you typically engage the services of a qualified patent agent who is registered to practice before the Intellectual Property of Vietnam (VNIPO). Here’s a step-by-step guide on how to file a patent application through a patent attorney in Vietnam:

Find a Qualified Patent Attorney:

You can look for a patent agent who is registered and licensed to practice before the VNIPO. You can search online directories, ask for recommendations from colleagues, or contact local intellectual property associations for referrals.

Please be noted that there are 2 kinds of agent, one can represent to your trademark only, one can represent for both your trademark and patent. For sure, you should confirm to your IP Agent before proceeding.

Initial Consultation: Schedule an initial consultation with the patent attorney to discuss your invention and the patent application process. During your conversation, provide the attorney with detailed information about your invention, including descriptions, drawings, and any prior art references.

You can evaluate the agent services during initial consultation, whether they meet your satisfactions about the content, time to respond, etc.

Preparation of Patent Application:

Work closely with your patent attorney to prepare the patent application documents, including the specification, claims, abstract, and drawings. Your attorney will ensure that the application meets the requirements of the VNIPO and includes all necessary information for patent protection.

If your patent application documents are in a language other than Vietnamese, the IP agent will arrange for accurate translations into Vietnamese.

Filing the Application:

Your patent attorney will submit the complete patent application to the NOIP on your behalf. They will ensure that all required forms are properly filled out, fees are paid, and supporting documents are included with the application.
