Brazil Updates Individual Fees under the Madrid Protocol: What Should Businesses Prepare For?
In today’s globalized economy, more and more businesses are using the Madrid Protocol as a strategic tool to protect their trademarks in multiple countries with just one application. This system not only saves time and costs but also serves as a “passport” for brands to confidently expand into international markets.
Recently, the World Intellectual Property Organization (WIPO) announced an important update: Brazil – the largest economy in South America – has officially modified its fee structure for international trademark registrations under the Madrid Protocol. These changes will directly impact businesses planning to secure trademark protection in Brazil, a market of over 210 million consumers.
1. Two key dates to remember
- From August 9, 2025:Brazil will continue applying a two-part fee structure.
- Application/Subsequent Designation: 61 CHF + 109 CHF per class
- Renewal: 146 CHF per class (Late renewal: 292 CHF per class)
- From September 20, 2025:Brazil will switch to a single-part fee system.
- Application/Subsequent Designation: 251 CHF per class
- Renewal: 146 CHF per class (Late renewal: 292 CHF per class)
In other words, after September 20, 2025, applicants will only need to pay once, instead of in two stages.
2. What this change means
- Simplified procedures:No more split payments.
- Clearer budgeting:One fixed fee per class makes cost planning easier.
- Strategic timing:Deciding whether to file before or after September 20, 2025 could affect total costs.
3. Why protect trademarks in Brazil?
Brazil is not just one market; it is the gateway to South America. With its large population, high purchasing power, and growing demand across industries such as food, beverages, fashion, cosmetics, technology, and services, it offers strong opportunities for international businesses.
