PATENT FEES IN VIETNAM

Estimating fees for the national phase entry of a PCT patent application in Vietnam involves several components. The fees can vary based on factors such as the number of claims, the number of priority rights, number of specification pages. Here’s a general outline of the steps involved:

1. Official Fee Schedule: Start by reviewing the official fee schedule provided by the Vietnam National Office of Intellectual Property (NOIP). This schedule typically outlines the various fees associated with patent applications, including filing fees, examination fees, and publication fees.

Below is a reference for official fees for reference:

(*) Classification of invention (IPC)* is only charged when the IPC is not provided in the application. Normally, the Patent Agent will helps you to do it.

(**) VNIPO has not published the entired filing specification, therefore, this fees currently not been charged now.

The substantive examination request can be filed simultaneously at the filing time or within 36 months for utility solutions and 42 months for invention from the earliest priority date/filing date.

2. Consider Additional Fees: In addition to the basic filing fee, there may be additional fees for services such as requesting examination, requesting accelerated examination, amendment of specification, assignment, etc. These fees should be accounted for based on your specific requirements. Please do not forget to estimate for postage of documents to Vietnam, bank fees for transfer money.

3. Translation Costs: If your original application was not filed in Vietnamese, you’ll likely need to provide translations of the application documents. Estimate the cost of translation services based on the length and complexity of the documents, and vary on each Patent Agent

4. Attorney Fees: If you’re working with a patent attorney or agent to handle the process, consider their fees for preparing and filing the application on your behalf.
